1. Introduction
Welcome to MailFAA operated by EZ Aviation LLC, a trusted provider of FAA U.S. Agent for Service solutions for individuals and entities with foreign addresses holding or applying for FAA certificates, ratings, or authorizations. These Terms & Conditions (“Terms”) govern your access to and use of our services and form a binding agreement between you and EZ Aviation LLC.
By registering for our service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Services Provided
MailFAA.com acts as a U.S. Agent for Service in accordance with FAA regulations outlined in 14 CFR Part 3, Subpart D (Sections 3.301 – 3.303). Our services include:
- Providing a compliant U.S. address for the FAA to serve documents.
- Receiving FAA-related correspondence on your behalf.
- Scanning and electronically forwarding those documents to your registered email.
- Supporting your ongoing FAA compliance as required.
3. Eligibility
To use our services, you must:
- Be an individual or entity required by the FAA to designate a U.S. Agent for Service.
- Provide valid and accurate identification and contact information.
- Maintain an active subscription with MailFAA.com
4. Client Responsibilities
By using MailFAA.com’s services, you agree to:
- Keep your contact and certificate-related information current.
- Ensure that your U.S. Agent for Service designation is properly submitted to the FAA.
- Monitor your email for any documents we forward on behalf of the FAA.
- Pay the required annual fee for continued service.
Failure to meet these responsibilities may result in termination or suspension of service and potential non-compliance with FAA regulations.
5. Document Handling & Liability
- MailFAA.com will forward FAA-related documents within two (2) business days of receipt.
- We are not liable for delays or non-compliance resulting from:
- Inaccurate or outdated client contact information.
- Client failure to act on forwarded FAA documents.
- Technical or transmission failures beyond our control.
We are also not responsible for legal consequences arising from your inaction or miscommunication with the FAA.
6. Fees & Payment
- The current service fee is $65 USD per year, subject to change with prior notice.
- Payment is required in advance to activate service.
- Services automatically renew each year unless canceled before the renewal date.
- Clients will be notified of upcoming renewals via email.
- No services will be provided without active payment.
7. Refunds and Cancellations
- All payments are non-refundable once registration is completed and service is activated.
- Clients may cancel their subscription at any time by contacting our support team.
- Cancellation stops future renewals, but no partial refunds will be issued for unused service periods.
8. Non-Payment Policy
- If payment is not received on or before the renewal date, services will be suspended.
- During suspension, we will retain received documents for 30 days.
- If payment is not received within 30 days, your account and documents will be permanently deleted.
- Reactivation within the grace period is allowed upon full payment.
- After the grace period, a new registration will be required.
9. Shipping Costs for Physical Forwarding
- Standard service includes electronic delivery only.
- If physical forwarding is requested, additional shipping fees will apply.
- Charges are based on the delivery method (standard or express) and destination.
- We will provide cost estimates in advance. Shipping will occur once payment is received.
10. Account Deletion
- Deleting your account results in the immediate and permanent deletion of all associated data, including FAA correspondence.
- No refunds will be issued for any remaining service time.
11. Termination & Suspension
MailFAA.com reserves the right to suspend or terminate your service without notice if:
- You provide false or misleading information.
- Payment is not received on time.
- You fail to meet FAA compliance obligations.
- You engage in any fraudulent, abusive, or illegal activities.
12. Limitation of Liability
- Our service is provided “as-is” and “as-available.”
- MailFAA.com is not liable for indirect, incidental, or consequential damages.
- Total liability for any claim shall not exceed the service fee paid by the client in the previous 12 months.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed under the laws of the State of Oregon, United States. Disputes will be resolved through binding arbitration in Oregon unless otherwise required by law.
14. Amendments
We may update these Terms at any time. Clients will be notified of significant changes via email or website notice. Continued use of our services constitutes your acceptance of the new Terms.
15. Acknowledgment
By signing up for FAA U.S. Agent for Service through MailFAA.com, you confirm that you have read, understood, and agreed to these Terms & Conditions.
